This Site provides the Provider, (collectively known throughout this agreement as “you” or “your” or “User”) with certain services, related to your participation in the Provider Portal, including but not limited to, access to your information (“Services”). The term “Provider” as used in these Terms and Conditions of Use shall mean facilities, home care providers, and other similar businesses. Use of this Site and the Services are subject to the Terms and Conditions of Use and all applicable laws. By using the Site, you agree to abide by all of the terms and conditions set forth in this notice. Unless stated otherwise, any new Services and materials added to this Site also will be covered by these Terms and Conditions of Use. 

PLEASE READ THESE TERMS CAREFULLY. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS ORCONDITIONS, DO NOT ACCESS OR OTHERWISE USE THIS WEBSITE OR ANY INFORMATION CONTAINED ON THIS WEBSITE. Services on this Site 

By registering for this Site, you will have the ability to set your ZIP codes of service, access materials, which include, but are not limited to, the Provider Manual and CareScout Highlights. Additionally, you have ability to provide information required for the credential process which includes requests for information about your business, services, and, if applicable, financial health.  

To the extent your information is updated on the Site, that information is automatically saved to our database.   

Information Provided by You 

In order to use the Services on this Site, you will have to register. You agree to provide true, accurate and current information as prompted by this Site. If any information you provide is untrue, inaccurate, incomplete or not current, or if CareScout has reasonable grounds to suspect that such information is untrue, inaccurate, incomplete or not current, CareScout, in its sole discretion, has the right to suspend or terminate your access to the Site. CareScout may periodically prompt you to review and update any information provided by you; however, you agree to update your Personal Information (defined in the Privacy Policy) and provider information promptly as changes occur. Further, you agree that CareScout will not be liable to you or any third party if CareScout terminates your access to the Site, and the Services or materials thereon, for any reason. 

CareScout acknowledges that certain information you provide to CareScout, including certain information in your survey and financial health responses, could include confidential or proprietary information. CareScout may send this information to third parties to continually assess your commitment to quality care. CareScout will treat this information confidentially and requires third parties who handle this information to do the same. Please be advised that CareScout does not consider information related to your scope of services, contact details, and location of services to be confidential or proprietary.  CareScout will display this information on CareScout.com and will share this information through paper, electronic, or phone communications with individuals who are seeking care.  

You further recognize that CareScout does not want you to, and you warrant that you shall not, provide any information or materials to CareScout that is defamatory, threatening, obscene, harassing, or otherwise unlawful, or that incorporates the proprietary material of another. CareScout will use Personal Information in accordance with the Privacy Policy posted on this Site. 

Information Provided by CareScout 

Certain information will be automatically provided by CareScout for your profile. If you find errors in this information, please contact CareScout at 800-846-4595. 

Communications to the User 

Notices from CareScout to you regarding your use of the Site, the Services and materials will be made by e-mail or regular mail, in the sole discretion of CareScout, unless otherwise required by law. 

Cancellation 

You may cancel your use of the Site at any time by contacting CareScout at 800-846-4595. However, any information you have provided by registering onto this Site will still display on CareScout.com. Additionally, canceling your use of the Site will not remove you from the CareScout Quality Network. 

Limited License 

Subject to the terms and conditions set forth in this Agreement, CareScout grants you a non-exclusive, non-transferable, limited right to access, and use this Site and the materials thereon. You agree not to interrupt or attempt to interrupt the operation of the Site in any way, whether such interruption is intentional or otherwise. CareScout authorizes you to use the Services and materials on this Site only for uses consistent with these Terms and Conditions of Use. CareScout hereby reserves all legal rights to remedy any such misuse or interruption of the Site, Services, and the materials.

CareScout reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will fully cooperate with CareScout in asserting any available defenses. 

Viruses 

There is always the possibility of unknowingly acquiring computer viruses on the Internet and thus we want to warn you about infections or viral contamination on your system. It is your responsibility to scan any and all downloaded materials received from the Internet. CareScout is not responsible or liable for any damage caused by viruses or related hazards, whether or not that virus or hazard resulted from a visit to this Site. You, and not CareScout, assume the entire cost of all necessary servicing, repair, or correction related to computer viruses.
